RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK

The individual named below (referred to as “I” or “me”) desires to participate in pickleball games, leagues, tournaments, training sessions, and related activities, including the use of indoor and outdoor courts, facilities, equipment, and surrounding areas (collectively, the “Activities”) organized, hosted, or operated by Founders League (the “Organization”).

1. ASSUMPTION OF RISK

I understand that participation in the Activities involves inherent risks, including but not limited to:

Slips, trips, and falls
Collisions with other participants, staff, or equipment
Injuries related to physical exertion
Equipment malfunction or failure
Exposure to weather conditions (if applicable)

I knowingly and voluntarily assume all risks, both known and unknown, even if arising from the negligence of the Organization or others.

2. RELEASE OF LIABILITY

I hereby release, waive, and discharge Founders League, its owners, officers, employees, contractors, volunteers, sponsors, affiliates, and facility providers (collectively, the “Released Parties”) from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury, including death, that I may sustain while participating in the Activities.

This release applies to any claims based on negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

3. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or costs (including attorney fees) they may incur due to my participation in the Activities, whether caused by my actions or otherwise.

4. MEDICAL AUTHORIZATION

I certify that I am physically fit to participate in the Activities and have not been advised otherwise by a qualified medical professional.

In the event of injury or medical emergency, I authorize the Organization to obtain medical treatment on my behalf if necessary. I understand that I am solely responsible for any medical expenses incurred.

5. RULES & CONDUCT

I agree to abide by all rules, policies, and instructions provided by Founders League, including safety guidelines and code of conduct. I understand that failure to comply may result in removal from participation without refund.

6. MEDIA RELEASE

I grant Founders League the right to photograph, record, and use my image, likeness, and voice in any media for promotional, marketing, or commercial purposes without compensation.

7. PERSONAL PROPERTY

I acknowledge that I am responsible for my personal belongings and that the Organization is not responsible for any lost, stolen, or damaged property.

8. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the state in which the Activities take place.

9. SEVERABILITY

If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. ACKNOWLEDGMENT OF UNDERSTANDING

I have read this Release and Waiver of Liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily.
